TEMPORARY RESIDENCE PERMIT (TRC)
A temporary residence permit is a type of document that foreigners who plan to stay in Poland for more than 3 months can apply for. We recommend that foreigners arriving in Poland on the basis of visas or those taking advantage of the so-called visa-free regime start the procedure for legalizing their stay immediately after their arrival in Poland.
In order to apply for a temporary residence permit, foreigners should already have a document confirming the right to the premises, because the choice of the Voivodeship Office to which the residence permit application will be submitted depends strictly on the place of residence. TEMPORARY RESIDENCE AND WORK PERMIT
In the case of temporary residence, it is important to confirm the purpose of stay in Poland. The most common type of applications for temporary residence permit are applications taking into account employment as the main purpose of stay in Poland. In such a case, the party to the proceedings is the foreigner, but the procedure also requires the submission of documents prepared by the employer. The main documents submitted in order to obtain a temporary residence and work permit in Poland include employment contract (regardless of its form – it can be both an employment contract and civil law contracts), documents confirming registration for social security, as well as confirmation that the current employer has the financial resources to provide the foreigner with the remuneration guaranteed by the contract.
TEMPORARY RESIDENCE AND WORK PERMIT FOR EMPLOYEES WITH HIGH QUALIFICATIONS - BLUE CARD
An increasingly popular type of residence card among foreign workers is the so-called Blue Card. It is issued to foreigners who have received a temporary residence and work permit for work in a profession requiring high qualifications. Candidates for this type of permit are required to have documented high qualifications related to the position for which they have been hired in Poland. Having high qualifications is primarily understood as the appropriate level and field of education or many years of experience in a given industry. Additionally, the law stipulates that a person applying for this type of residence permit should receive a minimum gross monthly salary not lower than the equivalent of 150% of the average salary in the national economy in the year preceding the submission of the application.
TEMPORARY RESIDENCE PERMITS FOR FAMILY MEMBERS
Many foreigners relocate to Poland with their entire families. Family members are also required to legalize their stay. It is not uncommon for family members to declare that they are financially dependent on their spouses/parents who are employed in Poland, and this gives them grounds to submit a residence permit application to obtain a residence card.
In the case of applications for family members, it is important to demonstrate family ties to the administrative body and to demonstrate financial dependence. Foreigners applying for this type of temporary residence permit should also provide evidence that they run a common household and wish to continue their family life outside their country.
TEMPORARY RESIDENCE PERMIT FOR THE PURPOSE OF CONTINUING STUDIES
The number of foreigners studying in Poland is increasing. Polish universities are opening up to students from abroad, offering courses in various languages. Many facilities have been prepared for foreign students, including the possibility of taking up employment without additional permits, but the obligation to legalize stay in Poland is the same for all foreigners.
Students applying for temporary residence permits to continue their studies are required to present documents confirming not only their current status as a full-time student, but also to demonstrate that their financial resources are sufficient to cover the costs of living, tuition and rent of a dormitory or room.

EXTENSION OF THE VALIDITY OF THE TEMPORARY RESIDENCE PERMIT
Polish temporary residence permits (TRP) and temporary residence cards (TRC) issued with them remain valid for a period from 3 months to a maximum of 3 years. Every foreigner who already has a residence card should plan in advance to renew the documents legalizing their stay in Poland. Please note that there is no special application to prolong the validity of an existing permit.
Each time it is a new application, exactly the same as when we apply for the first time. Foreigners should also submit previous residence permit decisions and copies of previous residence cards when applying for another residence permit.
PERMANENT RESIDENCE PERMIT AND EU LONG-TERM RESIDENT STATUS
After the appropriate period of time has passed and additional conditions have been met, such as knowledge of the Polish language or proof of family ties with Polish citizens, foreigners have the opportunity to submit an application for an EU long-term residence permit or a permanent residence permit. The stay of a long-term EU resident is legalized for an indefinite period, so there is no need to submit another application, as in the case of temporary stays. The EU long-term residence card must be replaced every 5 years to update the foreigner’s personal data and image.
Permanent residence permit is another type of indefinite legalization of stay in Poland. Permanent residence permit is issued to persons whose connections with Poland can be documented by for example Pole’s Card, extracts from registry offices confirming marriage, or in the case of children – documented Polish citizenship of one of the parents.
There are many possibilities to obtain permanent residence permits or an EU long-term residence permit. Assessing whether a person meets the statutory requirements to apply for this type of permanent permit is difficult, sometimes even for officials.
